The movie PRESUMED GUILTY is a documentary from Mexico which tells an incredible story of a young Mexican, Jose Antonio Zuniga, who was picked up off the street and charged with murder, which he knew nothing about. Two days after the arrest, Zuniga was sentenced to 20 years in prison by a judge who has never heard him speaking and based sentence on a testimony of single eyewitness. After the trial, Zuniga's family contacted two young Mexican lawyers from the USA and asked for help. They agreed to do so and started to film the story on a video. Surprisingly, young lawyers got a camera access in the Mexican court and prison system. The movie shows the details of the retrial, when it was assigned to the same judge who had already sentenced Zuniga for 20 years - it shows the process of the retrial, the testimonies of the only witness, as well as the policemen who arrested Zuniga. The sentence was the same. But after more than two years of struggle, appeals court judge watched the recordings of the retrial and released Zuniga, based on insufficient evidence. The documentary shows the tragedy of an ordinary young man whose story seems to be like those of thousands of prisoners in Mexico City. PRESUMED GUILTY, by telling about one real story, tells about the Mexican judicial system which presumes guilt. This story of Jose Antonio has a happy ending, but the details of the movie prove that it is very unlikely to happen in other similar stories. Archil Chochia |
